      PLEASE READ THIS PRIVACY POLICY CAREFULLY. We take the privacy of our users very seriously and are committed to protecting your privacy. This Privacy Policy is a part of our Terms of Use and it describes our policies on the collection, use, and disclosure of information about you in connection with your use of our services in our physical Inspire Fitness studios (“Studios”), and through our website, including our online store (the “Site”), Inspire Fitness Studios Fitness mobile application (the “App”), APIs, Products and services (collectively, the “Services”).

      The terms “HIM”, “we”, “us”, “our” and “Inspire Fitness” refer to Health In Motion LLC, its subsidiaries Inspire Fitness and Inspire Fitness Studios, and any third parties that it might engage in providing the Services and Products. The term “Product” shall refer to products available for purchase on our Site.

      When you use the Services, you consent to our collection, use, disclosure and transfer of information about you, including information that may be considered Personal Data (as defined below) for processing in the United States as described in this Privacy Policy. Your access to and use of the Services signifies that you have read and agree to all terms of this Privacy Policy. If you do not agree with any part of this Privacy Policy, or to our Terms of Use, please do not access or continue to use any of the Services or otherwise submit your Personal Data.

    2. INFORMATION THAT WE COLLECT

      “Personal Data” is information that a person can use, directly or indirectly, alone or together with other information, to identify you as an individual (for example, your name, email address), as well as any other non-public information about you that is associated with or linked to any of the foregoing. This may include your precise Location Data (defined below) and your Performance Data (defined below).

      “Anonymous Data” means data, including aggregated and de-identified data, that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons. Some examples include age, gender, browser and operating system, time spent using our Services, and webpages visited. Generally, we do not consider Anonymous Data to be Personal Data. However, if we link together

      Anonymous in a way that renders it individually identifiable, we will treat the combined information as Personal Data.

      We collect Personal Data and Anonymous Data as follows:

        1. When you directly provide Personal Data to us. This happens when you:
          1. Register with us and/or set up an account on our Services, for which we will require you to provide certain Personal Data, such as your name, a username, password, your email address, your date of birth and your mailing address. You may also choose to provide other information, or we may request other information when you set up your account and/or register with us, such as a profile picture, your contact number, and billing address.
          2. Purchase a Product on our Site, or in a Studio (for example payment information, e-mail address, shipping address).
          3. Contact us, provide feedback, sign up for newsletters, promotional emails or request other information (for example, your name and email address);
          4. When you take surveys and enter challenges, promotions, contests, and sweepstakes (for example name, email address, contact number, age);
          5. Manually input information into the Services, for example Location Data (as defined below) or the following information (collectively, “Performance Data”):
            • Information about your physical traits, such as height, weight, body measurements and age;
            • Information about your athletic or recreational activities, such as type of activity, exercise, frequency and performance goals;
            • Information about athletic performance, such as time spent doing an activity, speed, distance, cadence, hydration, and heart rate; and
            • Information about nutrition and conditions impacting performance, such as calorie intake, nutritional statistics, blood glucose and pressure, physiological condition, body temperature, how much you slept the prior evening, weight loss and gain, how you felt during a workout, and images/video demonstrating the impact to performance, fit, or comfort; or
            • Otherwise participate in activities or services we provide that require information about you.

        2. Automatically, when you use and interact with our Services. As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information as follows:
            1. Performance Data. We collect your Performance Data to help you track your fitness, nutrition, activity levels, sleep, goals and progress, to provide you with feedback (such as training and product recommendations) and to help us run our business, including:
                • When you employ features in the Services that are designed to capture Performance Data; and
                • When you leverage technologies that integrate or connect with our Services, such as certain mobile applications, wearables, or other fitness technologies (such as activity trackers, heart rate monitors, pedometers, and the like) that share Performance Data with our Services.
            2. Location Data . The Services include features that use precise geolocation data, including GPS signals, device sensors, Wi-Fi access points, and cell tower IDs (“Location Data”). We collect Location Data through the Services so we can offer you certain location-based services and conduct analytics to improve the Services. Please note we onlycollect Location Data if you have ‘allowed’ us to do so, and if you have, we collect it in several ways:
                • When you enable geolocation tracking or employ other features in the Services that are designed to capture Location Data;
                • From your wireless carrier, through a wearable or other device you have connected (for example, wirelessly) to our Services, and directly from the device on which you use our Services. Please note:(a) the way in which we collect Location Data is different depending on whether you are accessing the Services through a website or a mobile application; and (b) the collection of your Location Data may occur even when our Services are not actively open and running.
            3. Usage Information: When you use or interact with our Services, we receive certain usage or network activity information, including:
                • your general activity on the Service (e.g., your viewing history and search activity, including the date and time the Service was used);
                • identifiers such as an anonymized session identifier;
                • website traffic volume, frequency of visits, and type and time of transactions you initiate through the Service;
                • information regarding your interaction with email messages (e.g., whether you opened, clicked on, or forwarded an email message);
                • your Internet Protocol (IP) address;
                • the type and settings of the device, operating system, and browser used to access the Service;
                • websites you visit before and after using the Services; and
                • other information gathered through cookies and similar technologies, which are discussed further in the fourth section of this Privacy Policy, entitled “Cookies and Similar Technologies”, such as browsing and purchase data when you shop or purchase Products on our Site (for example, the Products you added to your shopping cart, whether or not you completed the purchase, your purchase details, returns and other transaction information regarding your purchases, such as the product purchased and price you paid).
        3. Information we receive from third parties. If you choose to connect your account on our Services to your account on another service, we may receive Personal Data from the other service. For example, if you connect to Facebook or Google,
          we may receive information like your name, profile picture, age range, language, email address, and friend list. You may also choose to grant us access to your exercise or activity data from another service. You can stop sharing the information from the other service with us by removing our access to that other service.We may also receive Personal and/or Anonymous Data about you from (a) companies that offer their products and/or services for use in conjunction with our Service or whose products and/or services may be linked from our Service; or (b) our service providers, including companies that assist with payment processing, analytics, data processing and management, and other services we may use to personalize your Service experience.

    3. HOW WE USE PERSONAL DATA

      We use Personal Data and Anonymized Data that we collect to communicate with you, to advertise, to provide our products and Services, to improve existing products and services, to develop new products and services, and to improve and personalize your experiences interacting with us, including as follows:

      1. Operate our business and provide our Services, including for example:
        1. To operate, maintain and provide you with all the content and features of the Services (for example, tracking your fitness and nutrition goals, fulfilling your purchases);
        2. To better understand our business, analyze our operations, improve the Services and to develop new products and Services to support your fitness, wellness and nutritional goals.
      2. Personalize experiences on our Services, better understand our members and customers, and gain consumer insights, including for example:
        1. To present Products and information that we think may be of interest and more relevant to you;
        2. To provide and improve features such as recording where a workout took place or mapping an activity;
        3. To personalize exercise and activity goals.

We use your Personal Data when needed to send you Service notifications and respond to you when you contact us, for example when you request technical support, product information or any other communication you initiate. We also use your information to promote new features or products that we think you would be interested in.       4. Enroll you in (at your request) and administer promotions, including for example:
        1. We use your Personal Data we collect during contests, challenges, sweepstakes and promotions to administer the Promotion, verify identity and age, and to communicate with you about the challenge or about other offers.
        2. For some challenges, promotions and surveys, we may ask questions, so we can conduct market research.
      5. Assist in our advertising and marketing campaigns, including for example to provide you with information on the Products and Services that we think are most relevant to you, and to enable us to measure the success of our marketing activities. For example, when corresponding with you via email, we may use “format sensing” technology, which allows pixel tags to let us know whether you received or opened our emails.         3. As Anonymized Data: We may use Anonymized Data in order to create statistical information regarding the Service and its use, which we may then share with third parties.

    6. “DO NOT TRACK” SIGNATLS

      Please note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit. The Service does not alter its practices when it receives a “Do Not Track” from a visitor’s browser.

      Our Site may contain links to third-party websites. When you click on a link to any other website or location, you will leave our Site and go to another site, and another entity may collect Personal Data from you. We have no control over, do not review, and cannot be responsible for these third-party websites or their content.     8. CONTROLLING YOUR PERSONAL DATA; DATA RETENTION AND ACCOUNT TERMINATION

      1. Consent. In order to process your Personal Data, we rely on your consent or our legitimate interests to process your Personal Data.       Inspire Fitness endeavors to be fully compliant with the GDPR. Inspire Fitness may act, depending on the circumstances, as either or both a Controller and a Processor of Personal Data (as these terms are defined in the GDPR). We act as the Controller of information that we ask you to provide to create an account, to sign up to our newsletter and information that we automatically collect when you use the Service. We act as the Processor of user-generated content and information provided to us by third parties or other websites.

      1. EEA and UK users have the following rights:
        1. Right to request copies of your Personal Data. We may charge you a small fee for this service.
        2. Right to object to our processing of your Personal Data, under certain conditions. However, we may be entitled to continue processing your information based on our legitimate interests or where this is relevant to legal claims.       We use commercially reasonable efforts to follow generally accepted industry standards to protect the personal data submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect information about you, we cannot guarantee its absolute security.

      You are responsible for the security of your digital wallet, and we urge you to take steps to ensure it is and remains secure. If you discover an issue related to your wallet, please contact your wallet provider.

    13. LOCATION OF DATA AND TRANSFERS OF INFORMATION

      The Site and App is owned and operated by Inspire Fitness, which is located in the United States. If you are a non-U.S. user of the Site and/or the App, by visiting the Site and/or the App and providing us with data, you acknowledge and agree that your Personal Data may be processed for the purposes identified in the Privacy Policy. In addition, your Personal Data may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Data may be less stringent than the laws in your country. By providing your Personal Data, you consent to such transfer.

    14. MODIFICATIONS TO THIS PRIVACY POLICY

      We may occasionally update this Privacy Policy. You can see when it was last updated by looking at the effective date at the bottom of this page. If we make any significant changes we’ll post them prominently on our website and notify you by other means as required by law.     1. General

      This Privacy Notice for California Residents supplements the information contained in the Privacy Policy of Health In Motion LLC (“HIM”) at [https://inspirefitness.com/privacy-policy/] (“Privacy Policy”) and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice. Any other defined terms have the meaning ascribed to them in our Privacy Policy.

    2. Information We Collect

      Our websites collect information that identifies, relates to, describes, and references is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, HIM’s websites have collected the following categories of personal information from its consumers within the last twelve (12) months:

      • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; and
      • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.HIM obtains the categories of personal information listed above from the following categories of sources both directly and indirectly, as described in our Privacy Policy.
      • Please note that some personal information may be collected from you in connection with your purchase of or registration for our products and services on third-party websites. For example, forms related to reservations, registrations and purchases, which capture certain personal information, may be hosted by our fulfilment partners. Such personal information is then shared with HIM and used in accordance with “Use of Personal Information” below.

When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

You have the right to request that HIM disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see “Exercising Access, Data Portability, and Deletion Rights”), we will disclose to you:

            1. sales, identifying the personal information categories that each category of recipient purchased; and
            2. disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
      2. Deletion Request Rights.  You have the right to request that HIM delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see “Exercising Access, Data Portability, and Deletion Rights”), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service providers to:
          1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
          2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
          3. Debug products to identify and repair errors that impair existing intended functionality.
          4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
          5. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
          6. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
          7. Comply with a legal obligation.
            1. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
        2. Exercising Access, Data Portability, and Deletion Rights. To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

            Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The verifiable consumer request must:

            • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
            • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
              1. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
          • Response Timing and Format. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

    5.  Non-Discrimination

      We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

      • Deny you goods or services.
      • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
      • Provide you a different level or quality of goods or services.
      • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.In the event that HIM does provide a CCPA-permitted financial incentive program that results in different prices, rates or quality levels, such program will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

    6. Other California Privacy Rights

      California’s “Shine the Light” law (Civil Code Section § 1798.83) permits California residents who use our websites to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.     7. Changes to Our Privacy Notice

      HIM reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on our websites and update the notice’s effective date. Your continued use of our websites following the posting of changes constitutes your acceptance of such changes.
